Executive order of the Cabinet of Ministers of the Republic of Azerbaijan for confirmation of regulations on recognition and determination of equivalence of higher education specialities of foreign countries
 
The Cabinet of Ministers of the Republic of Azerbaijan is hereby ordered, as follows:
 
 
1. Approve “Regulations on recognition and determination of equivalence (nostrification) of higher education specialities of foreign countries.” (Attached)
2. The order comes into effect on the signing day.

Regulations on recognition and determination of equivalence of higher education specialities of foreign countries
 
I. General provisions
 
 1.1. The present Regulation is prepared based on the section 1 of the Presidential Order 346 “On some actions concerning the application of the Law of the Republic of Azerbaijan on confirming the Convention on the Recognition of Qualifications concerning Higher Education in the European Region”, issued on March 6, 2000.
1. 2. Recognition of higher education specialties of foreign countries means any document, diploma or other certificate issued by authorities of foreign countries, and confirmed a successful completion of the higher education, is valid for the territory of Azerbaijan.
1.3. Determination of equivalence of higher education specialties of foreign countries signifies that owners of documents issued by authorities of foreign countries, and confirmed acquisition of specialties have the same academic and professional rights afforded to holders of higher education documents in the Republic of Azerbaijan.
1.4. Certificate of recognition and equivalence of higher education specialties of foreign countries gives to the holder the right to receive the additional (second) specialty, increase the qualification, admit to the next level of study after receiving a diploma, and carry out the relevant professional activity.
1.5. The nostrification does not release the holders of the certificate confirming the acquisition of specialties from the observance of general requirements determined by the laws of the Republic of Azerbaijan when they are applying for a job.
1.6. The Ministry of Education carries out the recognition of higher education specialties of foreign countries, and delivery of the certificate of recognition.
The certificate of determination of equivalence of higher education specialties of foreign countries will be issued by the Ministry of Education of the Republic of Azerbaijan after the relevant investigation procedure will be implemented.
If international contracts and interstate agreements to which the Republic of Azerbaijan is a party will define the equivalency, then the certificate will be issued without any inquiry.
1.7. The recognition and determination of equivalence of higher education of foreign countries and delivery the identical certificate is implemented according to the request of the document’s holder or appeal of the interested organization, as well as legal and physical entities.
 
 
II. Organization of procedure for recognition of specialties in the higher education area
 
 2.1. Following documents should be submitted to the application for the recognition of speciality:
- Document on higher education;
- Appendix to the diploma and details of study programs, their volume, total assessment, results for internships, essays, coursework and thesis;
Applicant allowed to present documents confirming his preparation level and practical experience for the relevant professional work as well.
The document on higher education and its Appendix translated into Azerbaijani and certified by a notary public should be legalized by the embassy (consulate) of the Republic of Azerbaijan operated in the country issued the educational document, or in the Consular Department of the Ministry of Foreign Affairs of Azerbaijan. 
2.2. The procedure for recognition of specialties in the higher education area is being implemented based on existing international contracts and recommendations, state educational standards and normative legal acts, which regulate the education system of the Republic of Azerbaijan.
2.3. The higher education specialties should be:
- recognized by the country issued the document;
- specified in the international contracts of the Azerbaijan Republic.
2.4. Documents presented by the applicant will consider within 1 (one) month of the date of presentation of all necessary documents.
2.5. If the document submitted for recognition will be denied the reason for refusal will be explained to the applicant in a written notice.
 
III. Determination of equivalence of higher education specialties
 
3.1. In order to define the equivalence of higher education specialties documents listed in the article 2.1 of the present Regulations should be submitted.
3.2. Definition of the equivalence of higher education specialties is carried out through:
Examination – recognition of higher education specialties of foreign countries and definition of compliance of the education acquired in the foreign country with educational standards of the Republic of Azerbaijan;
- determining equivalent in educational content (after recognition of the higher education speciality of the foreign country) acquired in the foreign country with state educational standards of the Republic of Azerbaijan.
3.3. In order to determine educational content being equivalent to state standards the Ministry of Education of the Azerbaijan Republic established scientific and methodical sections, and the Expert Group consists of highly skilled experts.
3.4. During the investigation procedure, the following taken into account:
- program descriptions, curriculum content;
- attestation system;
- volume of studied subjects;
- results for subject attestation;
- industrial practice and its term;
- final attestation result.
The expert opinion on the conformity of the educational content received abroad with state educational standards of Azerbaijan, as well as methods for eliminating identified inconsistencies is being submitted to the Ministry of Education of the Azerbaijan Republic. The applicant has the right to become familiar with expert materials.
3.6. Certificate of Equivalence issued based on: a positive conclusion about the recognition of education speciality, positive opinion of expert on the conformity of the educational content; international contracts to which Azerbaijan has acceded to. Moreover, conformance to requirements submitted to relevant structures of education in the country that issued the document and in the Azerbaijan Republic.
3.7. Negative conclusion for one of the provisions pointed out in the section 3.6 could be the reason for refusal in delivery of the Certificate of Equivalence. Negative conclusion can be written in following cases: the general standard term of the acquisition of speciality in the higher education area of the foreign country one year less than the term provided by the state educational standards in the Azerbaijan Republic; rights given to the document owner on education in the foreign country less than rights given by the corresponding document in the Azerbaijan Republic (for example: if the document owner has no right to receive the doctoral studies or work in the desired profession; when the education received in the foreign country has the extramural or full-time - extramural form, and such forms of education are not provided in the Azerbaijan Republic).
3.8. The examination could be carried out for reception of the certificate on the recognition and equivalence in case of distinctions between minimum obligatory requirements submitted to the content and level of specialist preparation or if the preparation area will not match the directions and lists of the higher education received in the Azerbaijan Republic. In cases of necessity and the will, the applicant can take part in lectures on subjects on which he will take the exam.
                                   
IV. Registration
 
4.1. The certificate of recognition and determination of equivalence of higher education specialities of foreign countries is being signed by the Minister of Education of the Republic of Azerbaijan and approved by the official stamp of the Ministry. Afterwards, it will be presented to the applicant or its official representative, or delivered via email (Appendix 1 or 2).
4.2. If the applicant will not be satisfied with the reason for refusal he might appeal against the decision. Appendix 1 to “Rules for recognition and determination of equivalence (nostrification) of higher education specialities of foreign countries”, Appendix 1 to the order of the Ministry of Education of the Azerbaijan Republic from ______ 2003, the Ministry of Education of the Azerbaijan Republic, Baku city ___________ year, the Certificate (only original of document and its notarized translation are valid). It is hereby certified that the document on education given to ___________________________ (full name) ____________ (date of issue) __________________________ (name of educational establishment issued the document) __________________________________ (about the higher education) _______________________ (name, serial number of document) is the equivalent (equal) to the diploma issued on _________________ specialty/direction in the Republic of Azerbaijan. Minister L.S. Registration number: _______.
Appendix 2 to “Rules for recognition and determination of equivalence (nostrification) of specialities in the higher education area of foreign countries”, Appendix 2 to the order of the Ministry of Education of the Republic of Azerbaijan from ______ 2003, the Ministry of Education of the Republic of Azerbaijan, Baku city ___________ year, the Certificate (only original educational document and its notarized translation are valid). It is hereby certified that the document on the higher education given to ___________________________ (full name) ____________ (date of issue) __________________________ (name of educational establishment issued the document) __________________________________ (about the higher education) _______________________ (name, serial number of document) is the equivalent (equal) to the diploma issued on _____________ specialty/ direction in the Republic of Azerbaijan and gives its possessor the right to be admitted to the next level of education.
